Terms of Service

These Terms of Service ("Terms") govern your access to and use of CaseFlow AI ("CaseFlow," "we," "us"), a software service that generates patient-friendly treatment plan summaries for dental practices. By creating an account or using the service, you agree to these Terms.

1. The Service

CaseFlow lets authorized dental professionals upload treatment plan documents and related images, uses artificial intelligence to extract and summarize their contents, and produces shareable patient-facing summary pages. The service is provided to dental practices and their staff, not directly to patients.

2. Accounts and Eligibility

• You must be a dental professional or authorized staff member of a dental practice to create an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must provide accurate information when registering and keep it current.

3. Professional Responsibility and AI-Generated Content

CaseFlow uses AI to generate summaries. AI output may contain errors or omissions. You acknowledge and agree that:

• Summaries are patient-education aids, not medical or dental advice, diagnoses, or treatment recommendations.
• The treating dentist is solely responsible for reviewing each summary for clinical and financial accuracy before sharing it with a patient.
• CaseFlow does not create a provider-patient relationship and is not a substitute for professional judgment.

4. Patient Data and HIPAA

• Content you upload may contain protected health information ("PHI"). You represent that you have the legal right and any required patient authorizations to upload and share such content.
• Where CaseFlow acts as a business associate under HIPAA, a Business Associate Agreement ("BAA") is available and, once executed, governs our handling of PHI. Contact us to execute a BAA before submitting PHI.
• You are responsible for how you share summary links. Shareable links are accessible to anyone who possesses them unless you restrict a plan's visibility.

5. Acceptable Use

You agree not to: (a) use the service for any unlawful purpose; (b) upload content you lack rights to; (c) attempt to probe, disrupt, or gain unauthorized access to the service; (d) resell or sublicense the service without our written consent; or (e) use the service to build a competing product.

6. Fees

Paid subscription tiers, billing terms, and any free-trial terms are presented at purchase. Fees are non-refundable except where required by law. We may change pricing with at least 30 days' notice.

7. Intellectual Property

We own the service and its software. You own the content you upload and the summaries generated for your practice, and you grant us a license to process that content solely to provide and improve the service.

8. Termination

You may cancel at any time. We may suspend or terminate accounts that violate these Terms. Upon termination you may request deletion of your practice's data.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASEFLOW'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, AND WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

10. Changes

We may update these Terms from time to time. Material changes will be communicated via the service or email; continued use after changes take effect constitutes acceptance.
